1. Rights Recognized by Law
1.1 This limited warranty describes the responsibilities of NOWA Inc. ("NOWA") with respect to NOWA Products. NOWA cannot exclude any implied rights or statutory warranties granted to you under applicable law. Nothing in this limited warranty affects those rights.
1.2 If you are a consumer, you are protected by the consumer protection laws and regulations in force in your country, state, or province of residence. As a result, certain limitations set out in this limited warranty may not apply to you. In Quebec, the legal warranty of quality and durability provided for in the Civil Code of Québec and the Consumer Protection Act applies in addition to this limited warranty and cannot be excluded.
1.3 This limited warranty is in addition to, and does not replace, statutory warranties.
2. Definitions
"NOWA Product" means any water leak detection and shutoff system, as well as its components, parts, and accessories, manufactured by or on behalf of NOWA, generally including, without limitation, a control panel, wireless detectors, and a motorized valve.
"YOU" means the individual or legal entity that acquired the NOWA Product from an Authorized Seller or directly from NOWA, or any person or entity to whom the warranty has been validly transferred in accordance with Section 4. A property manager may act as the authorized representative of the beneficiary without becoming the warranty holder solely as a result of such management.
"Authorized Seller" means NOWA itself, including through its online store, as well as any distributor, reseller, or installer duly authorized by NOWA to sell NOWA Products, according to the list maintained by NOWA.
"Qualified Installer" means a plumber or plumbing company holding the licences and qualifications required by law in the jurisdiction where the installation is performed and, where applicable, having completed the applicable NOWA certification.
"Commissioning" means the date on which the NOWA Product is installed, powered on, registered, and communicating with the NOWA platform.
"Valve Body" means the mechanical stainless-steel valve installed on the piping, excluding the motor, actuator, wiring, electrical or electronic components, batteries, and any removable accessory.
"Warranty Period" means the period applicable to each component, as set out in Section 3.
"Eligible Equipment and Batteries" means the NOWA equipment and batteries expressly covered by the applicable PRESENCE plan as of the initial Commissioning date, subject to the plan terms provided to the beneficiary at the time of subscription.
3. Scope and Duration of the Warranty
3.1 NOWA warrants to YOU that the NOWA Product will be free from defects in materials and workmanship under normal conditions of use for the following periods:
- a) electrical and electronic components, including the control panel and wireless detectors: two (2) years;
- b) valve motor and actuator: three (3) years;
- c) Valve Body: twenty-five (25) years;
- d) any other NOWA component, part, or accessory not covered by paragraphs a) to c), including amplifiers, repeaters, and antennas supplied by NOWA: two (2) years.
3.2 The Warranty Periods begin on the earlier of: i) the Commissioning date; or ii) the first anniversary of the NOWA Product's purchase date.
3.3 The twenty-five (25)-year warranty applicable to the Valve Body covers only defects in materials and workmanship of the Valve Body, as defined in Section 2. It does not extend the Warranty Periods applicable to the motor, actuator, or other system components.
3.4 If the NOWA Product is repaired or replaced during the Warranty Period, the warranty applicable to the repaired or replaced product expires on the expiration date of the original Warranty Period, unless prohibited by applicable law.
3.5 The basic warranty set out in this Section applies regardless of whether a PRESENCE plan has been subscribed to. The subscription, expiration, or cancellation of a PRESENCE plan does not reduce the basic Warranty Periods.
3.6 Subject to the terms of the applicable PRESENCE plan, the Plus and Pro plans include two (2) years of coverage for Eligible Equipment and Batteries, without reducing any longer basic Warranty Period. The Pro Premium plan includes five (5) years of coverage for Eligible Equipment and Batteries. All such periods begin on the initial Commissioning date.
3.7 Extended coverage requires an eligible and continuous subscription to the applicable plan. It does not retroactively cover a defect or event that occurred before the subscription or during an interruption of the plan. The twenty-five (25)-year warranty on the Valve Body remains unchanged.
4. Transfer of the Warranty
4.1 This limited warranty is not transferable except: a) as provided in Section 4.2; b) with NOWA's prior written authorization; or c) where required by applicable law.
4.2 Where the NOWA Product was acquired by a developer or builder for permanent installation in a condominium unit or in the common areas of a building, the warranty is transferred once, without extending its original duration: for a unit system, to the first legal owner of that unit; for the common areas, to the condominium corporation or entity that legally assumes control of the building. A property manager may submit a claim as the beneficiary's authorized representative.
4.3 Any other assignment, including upon the resale of a unit or building, requires NOWA's prior written authorization and never extends the original duration of the warranty, subject to any mandatory rights provided by applicable law.
4.4 This limited warranty applies only to NOWA Products purchased from NOWA or an Authorized Seller and installed in Canada or the United States.
5. What NOWA Will Do
5.1 During the applicable Warranty Period, if NOWA determines that the NOWA Product is defective, NOWA may, at its sole discretion:
i) repair the defective part at no charge using new or refurbished parts;
ii) replace the defective NOWA Product with a new or equivalent NOWA Product; or
iii) if NOWA is unable to repair or replace the NOWA Product, refund to YOU the net purchase price YOU paid for it.
5.2 The warranty exclusively covers the supply of the repaired or replacement part or Product. For any claim authorized in advance, NOWA will pay the reasonable shipping costs for the part or Product believed to be defective to the facility designated by NOWA and for the repaired or replacement part or Product to the beneficiary, within Canada or the United States. Except where required by applicable law or under a separate written agreement, the warranty does not cover the costs of on-site diagnosis, travel, dismantling, removal, draining, restoring the water supply, reinstallation, connection, reCommissioning, or restoration of the premises. These costs are governed by any separate agreement between the customer and their installer.
5.3 The replaced item becomes the property of NOWA, and the replacement item becomes your property. When a refund is issued, YOU will return the NOWA Product to NOWA, and it will become the property of NOWA.
6. Wireless Communications and Signal Quality
6.1 NOWA Products incorporate radio communication devices, including Wi-Fi and cellular communication devices, as well as wireless radio links between the control panel and the detectors.
6.2 The range, strength, and stability of these links depend on factors specific to each building and to the environment in which the product is installed, over which NOWA has no control, including:
- a) the nature, thickness, and arrangement of construction materials, including concrete, reinforced concrete, masonry, structures, membranes, and metal cladding;
- b) the geometry and area of the premises, the number of floors, the distance between devices, and the presence of obstacles;
- c) piping, ducts, appliances, and furniture;
- d) electromagnetic noise and interference, including that from other wireless devices or networks;
- e) the cellular network operator's coverage, capacity, and availability at the location in question;
- f) the capacity, configuration, bandwidth, security settings, and availability of the customer's Wi-Fi network and Internet service, as well as customer-owned network equipment;
- g) any change made to the building, its layout, furniture, equipment, or networks after installation.
6.3 As a result, signal quality may vary from one building to another, from one unit to another within the same building, from one room to another, and over time.
6.4 NOWA does not guarantee the availability, range, strength, continuity, or performance of the cellular, Wi-Fi, or radio signal at any given location. This limited warranty covers defects in materials and workmanship of the NOWA Product, not the radio propagation conditions at the installation location.
6.5 NOWA is not responsible for interruptions, degradation, delays, or loss of communication attributable to the factors listed in Section 6.2, or for the consequences of such interruptions, including the failure to transmit an alert or the late transmission of an alert.
6.6 YOU are responsible for maintaining the communication conditions required by the installed configuration, including electrical power and, where applicable, Internet service, Wi-Fi, or any other required communication service, as well as access to the devices for maintenance and inspection purposes.
7. Signal Optimization Assistance
7.1 When a communication issue is reported, NOWA may provide reasonable remote assistance to identify the situation and recommend optimization measures. Such assistance may include:
a) remote diagnosis of the system, its radio links, and its connectivity;
b) technical recommendations regarding potential optimization measures, including repositioning devices and adding amplifiers, repeaters, or external antennas.
7.2 Remote assistance reasonably required to assess a warranty claim is provided at no charge during the Warranty Period applicable to the control panel. Any additional technical assistance is provided in accordance with the active PRESENCE plan or the terms of service then in effect.
7.3 NOWA is a manufacturer and does not undertake to provide on-site visits. Any on-site diagnosis or work, including repositioning devices and installing amplification equipment, is performed by a Qualified Installer or an Authorized Seller and is subject to a separate agreement between the customer and that service provider. NOWA is not a party to that agreement and assumes no responsibility in connection with it.
7.4 Amplifiers, repeaters, antennas, and other equipment required to improve signal quality are supplied separately and invoiced at the current price by NOWA or by your Authorized Seller, as applicable.
7.5 The remote assistance provided for in this Section does not include: any on-site visit or diagnosis; plumbing, electrical, construction, drilling, cable-pulling, or finishing work; the supply, upgrade, or repair of the customer's Internet or cellular service; the replacement or reconfiguration of customer-owned network equipment; amplification equipment; or travel, labour, dismantling, and reinstallation costs.
7.6 The assistance provided for in this Section carries no obligation to achieve a particular result and does not constitute a guarantee that a communication issue can be resolved. The characteristics of the building, the location of the equipment, interference, and the absence or insufficiency of a cellular, Wi-Fi, Internet, or other third-party network do not, in themselves, constitute a defect in the NOWA Product and do not entitle YOU to a refund under this warranty, unless otherwise provided in a separate written agreement. Any confirmed defect in hardware, software, or firmware supplied by NOWA remains subject to the applicable remedies under this warranty.
7.7 Additional services intended for multi-residential, commercial, or institutional buildings, including portal configuration, management of multiple sites, reports, user administration, and technical support levels, are governed by the PRESENCE plan or a separate service agreement. They do not change the remedies applicable to the hardware under this warranty.
8. Nature of the Product and Limits of Protection
8.1 The NOWA Product is a water leak detection and shutoff system. Its purpose is to reduce the risk of water damage. It is neither insurance nor a guarantee that no water damage will occur.
8.2 No detection system can detect every leak under all circumstances or prevent all damage. The NOWA Product detects only water that reaches a detector or perimeter cable and shuts off only the water supply downstream of the installed valve.
8.3 NOWA does not collect insurance premiums and does not act as an insurer. YOU are responsible for maintaining appropriate insurance coverage for the building and its contents. NOWA does not guarantee any premium reduction, insurance credit, or acceptance by an insurer.
9. Your Obligations
9.1 For this limited warranty to remain applicable, YOU must:
a) have the NOWA Product installed by a Qualified Installer in accordance with the installation manual, NOWA specifications, and applicable codes and regulations;
b) periodically verify that the system is operating properly at the frequency indicated in the user manual, including testing the detectors and the valve;
c) replace the batteries in wireless detectors as soon as a low-battery alert is reported;
d) maintain the communication conditions provided for in Section 6.6;
e) report to NOWA, within a reasonable time, any defect, fault alert, or loss of communication observed;
f) retain proof of purchase and proof of installation.
10. Exclusions and Limitations
10.1 This limited warranty does not apply:
i) to normal wear and tear;
ii) to batteries, consumables, and wear parts, except that batteries are warranted for ninety (90) days against manufacturing defects and may qualify for the extended coverage provided for in Sections 3.6 and 3.7. Normal battery depletion remains excluded unless the terms of the applicable PRESENCE plan expressly provide for a replacement service;
iii) to defects or damage caused by improper disassembly, modification, or repair;
iv) to defects or damage caused by an incompatible, unsuitable, or non-NOWA component;
v) to damage caused by misuse, accident, negligence, vandalism, freezing, power surge, lightning, or a casualty event;
vi) to damage caused to the NOWA Product by operation or use that does not comply with the user manual and specifications;
vii) if the NOWA Product has been submerged in water or another liquid, except for components designed to come into contact with water;
viii) if the installation is improper or is performed by anyone other than a Qualified Installer;
ix) to an installation that does not comply with applicable local codes and regulations;
x) if the NOWA Product was not purchased from an Authorized Seller or directly from NOWA;
xi) to the communication issues, interruptions, or losses referred to in Section 6, and to the quality of the cellular, Wi-Fi, or radio signal;
xii) to the interruption, degradation, or discontinuation of services by an Internet service provider, cellular network operator, or any other third party;
xiii) to failure to comply with your obligations under Section 9;
xiv) if the applicable Warranty Period has expired.
11. Claim Procedure
11.1 To submit a claim, contact NOWA customer service at info@nowa360.com or 1-877-287-7777, option 5, or contact your Authorized Seller. NOWA will provide YOU with the applicable instructions.
11.2 NOWA may require YOU to provide reasonable evidence of the NOWA Product's purchase and installation dates, including a dated receipt or invoice from NOWA or an Authorized Seller, the serial number and Commissioning record, or documentation from the developer, builder, or Qualified Installer.
11.3 Depending on the component concerned, NOWA may require that the part or NOWA Product be returned to its facilities, provide an advance replacement subject to return of the part believed to be defective, or request that a Qualified Installer perform on-site work under a separate agreement. For any authorized return, NOWA provides shipping instructions and pays the reasonable costs provided for in Section 5.2. No return is required unless requested by NOWA.
11.4 Parts or products returned without NOWA's prior authorization may be refused.
12. Telecommunications Networks, Platform, and End of Life
12.1 For certain functions, the NOWA Product depends on telecommunications networks operated by third parties and on NOWA'S PRESENCE service platform. This limited warranty does not cover third-party networks or the PRESENCE platform as a hosted service, which are governed by their own terms. Software and firmware embedded in the NOWA Product nevertheless remain subject to the applicable remedies under this warranty when a defect is confirmed.
12.2 If an operator discontinues a network technology used by the NOWA Product, or if NOWA discontinues the production or support of a model, NOWA will inform YOU within a reasonable time and may offer a replacement or upgrade solution. Such end of life does not terminate or reduce the twenty-five (25)-year warranty applicable to the Valve Body.
12.3 NOWA maintains reasonable availability of compatible replacement parts and support for the software and firmware it controls for the essential functions of the NOWA Product for the longer of: i) three (3) years following the model's last commercial sale in Canada or the United States; or ii) any longer period required by applicable law.
12.4 The commitment set out in Section 12.3 does not guarantee compatibility with all future networks, devices, operating systems, or services operated by third parties, or the continued availability of a cloud or cellular service beyond the period provided for in the applicable service agreement. If an identical part is no longer available, NOWA may offer a functionally equivalent part or an upgrade option.
13. Exclusive Remedies
13.1 Unless expressly prohibited by applicable law, this limited warranty and the remedies expressly provided for herein constitute your exclusive remedies with respect to the NOWA Product and replace any other warranty, condition, or remedy, express or implied.
14. Limitation of Liability
14.1 To the fullest extent permitted by applicable law, NOWA, on its own behalf and on behalf of its distributors, Authorized Sellers, subcontractors, and service providers, disclaims all other warranties, conditions, or representations of any kind, express or implied. Where an implied warranty cannot be disclaimed but may be limited in duration, its duration is limited to the applicable written Warranty Period. Nothing in this Section excludes, limits, or modifies any statutory or implied warranty that cannot lawfully be excluded, limited, or modified.
14.2 Unless expressly prohibited by applicable law, NOWA will in no event be liable for any indirect, incidental, special, or consequential loss or damage of any kind, or for damages caused by loss of profits, business interruption, loss of data, or any other pecuniary loss arising from the use of or inability to use the NOWA Product, even if NOWA has been advised of the possibility of such damages. This limitation applies whether damages are claimed in contract, tort, under warranty, or under any other law or form of action.
14.3 Subject to Section 14.4, NOWA's total liability to you for any loss or damage arising from this limited warranty may not exceed the greater of the net purchase price YOU paid for the NOWA Product concerned or the cost of replacing it.
14.4 Nothing in this limited warranty excludes or limits NOWA's liability for death or personal injury arising directly from its negligence or that of its employees or agents, or in the event of gross or intentional fault.
14.5 Some countries, states, or provinces do not allow the exclusion or limitation of indirect or consequential damages. The foregoing exclusions and limitations may therefore not apply to YOU.
14.6 For consumers in the United States: This warranty gives YOU specific legal rights, and YOU may also have other rights which vary from State to State.
15. Applicable Laws
15.1 This limited warranty and any claim or dispute relating to it are governed by the following laws, except to the extent prohibited by applicable law:
a) if YOU reside in the Province of Quebec: the laws of the Province of Quebec;
b) if YOU reside in Canada, outside Quebec: the laws of the Province of Ontario, excluding its conflict-of-laws rules;
c) if YOU reside in the United States: the laws of the State of New York, excluding its conflict-of-laws rules.
15.2 The United Nations Convention on Contracts for the International Sale of Goods is excluded in its entirety.
15.3 For the purposes of Sections 15 and 16, a legal entity is deemed to reside at its principal place of business unless applicable law requires a different connecting factor.
16. Dispute Resolution
16.1 If YOU reside in the Province of Quebec, this Section does not apply, and the courts of Quebec have jurisdiction.
16.2 If YOU are a consumer residing outside Quebec, nothing in this Section requires YOU to submit a dispute to arbitration where applicable law permits YOU to commence a court or class proceeding. Arbitration may then be used only by mutual agreement reached after the dispute arises.
16.3 If YOU are not a consumer, any dispute arising from this limited warranty will be resolved by final and binding arbitration:
i) in Ontario, Canada, if YOU reside in Canada, under the Arbitration Act, 1991 (Ontario), by a single arbitrator appointed in accordance with that Act;
ii) in New York, New York, if YOU reside in the United States, under the Commercial Rules of the American Arbitration Association, by a single arbitrator appointed in accordance with those rules.
16.4 For any arbitration conducted under Section 16.3, YOU agree that a judgment confirming the arbitration award may be entered by any court of competent jurisdiction, and YOU irrevocably consent to the jurisdiction of such court. No dispute may be joined or consolidated with a dispute involving any person other than YOU without NOWA's prior written consent.
17. Miscellaneous Provisions
17.1 Any waiver by NOWA of a default does not constitute a continuing waiver of that default or a waiver of any other default.
17.2 If any provision of this limited warranty is held to be invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect.
17.3 This limited warranty is drafted in French. Any English version is provided for convenience; in the event of any discrepancy, the French version prevails in Quebec.
17.4 This limited warranty replaces all previous versions and applies to NOWA Products sold and installed in Canada or the United States on or after August 20, 2026.
17.5 NOWA Products sold or installed outside Canada or the United States are subject to separate warranty terms communicated in writing at the time of sale. This limited warranty does not apply to them.
